Geen Circoloco @ DC10 (Ibiza) dit jaar.
Nobody works the rumour mill harder than dc10, even if the club and CircoLoco posse aren't actually saying anything themselves.
Over the last 2 weeks that silence has become deafening as almost everyone seemed to be saying June 1st would be crazy circus time again. It's the best hype going; you do nothing, say nothing and the blogs, the forums and the gossip mongering do it all for you.
Yet, sadly the rumours are wrong. Today the Diario De Ibiza reports that the TSJB (Tribunal Superior de Justicia de Balears), that's the High Court of the Balearics for want of a better description, has rejected dc10's appeal to have their yearlong ban lifted by firmly restating the fundamental reasons behind why the sanction was imposed in the first place. The crux of the matter comes back to the licencing and capacity issue, for whilst the TSJB recognised that a licence exists, it doesn't relate to the activities that have actually been taking place there, so in effect those activities have been clandestine.
To quote the TSJB with reference to dc10; " a café-concierto for a capacity of 65 people has become a discoteca with 34 workers and a lot more people attending than are allowed".
They go on to effectively say that dc10, knowing full well the limits of its own licence, have been operating illegally when conducting any activity that falls outside the remit of that licence. Understandably, the Court's ultimate stance is that it "concludes it is more important, to the general
interest, that whatever activities are taking place have proper approval and authorization", so therefore "individual interests have to give way", for example, "it is difficult to take into consideration affected jobs when they are for activities that are secret, and therefore, illegal."
Under the letter of the law, it's pretty much a black and white case, dc10 broke the rules and have been punished. What that means for CircoLoco and its resident jocks in 2009, time will only tell, but you can guarantee that the saga is far from over.
